Revilla Seeks Urgent Issuance of TRO
Sen. Bong Revilla Jr. has urged the Supreme Court (SC) to immediately act on his petition for the issuance of a Temporary Restraining Order (TRO) enjoining the criminal proceedings before the Office of the Ombudsman and subsequently before the sandiganbayan in connection with the Php 10 Billion Pork Barrel/PDAF Scam. Revilla filed the urgent motion for the issuance of a TRO and/or writ of preliminary injunction last Friday following the Ombudsman's issuance of a joint resolution last Mar. 28, 2014 finding probable cause to indict him for the crime of plunder. The senator through his lawyer Atty. Bodegon lamented that his petition for certiorari and prohibition filed last Mar. 10, 2014 would be rendered moot and academic if the court wouldn't immediately act on it. Revilla's camp insisted that the Ombudsman should have exercised prudence from performing any act that would affect the status of the case considering that the Court has already set it for an oral argument. It can be recalled that Revilla filed his petition for certiorari and prohibition assailing the Jan. 28, 2014 and Mar. 3, 2014, orders issued by the Ombudsman denying his motions to suspend preliminary investigation of the plunder case filed against him and several others by the National Bureau of Investigation (NBI). Revilla sought the issuance of a TRO and/or WPI to enjoin the Ombudsman from conducting the proceedings on the case of on the ground of a clear presence of prejudicial question due to the pending civil complaint for nullity of PDAF documents before the Regional Trial Court (RTC) of Bacoor City.
